Terms & Conditions
All prices on Bluecaravan are currently in Australian Dollars (AU$)
Bluecaravan is an on-line venue for buying, selling and wholesaling. All transactions &/or interactions occur solely and completely between sellers and buyers. Bluecaravan plays no part in the transactions and/or interactions that occur between these parties other than suggesting guidelines for them to operate within. Bluecaravan takes no responsibility, in any way, for the product, the quality or integrity of product, the transaction, the interaction or any consequences resulting from these or any other activities on Bluecaravan.
When you initiate a relationship with Bluecaravan (through signing up for membership) you will be asked to read these terms & conditions and you will be asked to click the ‘I Agree’ button. You should only agree to these conditions when you fully understand them. If you click the ’I Agree’ button and successfully complete the sign-up process you will enter into a contract with Bluecaravan. By using the www.bluecaravan.net website you are agreeing to be bound to the ‘terms & conditions’ (this user agreement) as they are described here.
When you use Bluecaravan, you do so at your own risk.
If you want to cancel this contract, and thereby cancel your account & membership with Bluecaravan, you can do so by contacting Bluecaravan at support@bluecaravan.net . Your membership & account will only be terminated after all arrears are settled in full.
Bluecaravan reserves the right to change these conditions at anytime, upon which time those changes will be posted on this website. It is your responsibility to keep up-to-date with changes to the Terms & Conditions of Bluecaravan.
Registration & Eligibility to Register

Registration is free of charge.

To register and become a member of Bluecaravan you must be 18 years or older, and you must be able to form a legally binding contract under the relevant laws.

If you are registering as a business entity, you are declaring that you have authority to act on behalf of the business entity for which you have registered.

You must choose a password that does not contain easily identifiable number/letter combinations (such as birthdates, driver’s license numbers, phone numbers etc) or repetitive or patterned number/letter sequences.

You must keep your password safe and must not disclose it to any other parties. You must not allow anyone to directly or indirectly use your Bluecaravan account, or to give/sell your account to another party.

We (Bluecaravan) reserve the right to use a third party to validate the information provided in your registration.

The information provided in the registration and in relation to your account must be true, correct and not ambiguous; and must be updated whenever changes occur.

It is your responsibility to keep your registration and account up-to-date and correct.
Account Suspension & Cancellation

We (Bluecaravan) reserve the right to refuse or cancel membership at any time for any reason and to forfeit any special arrangements made in relation to those accounts.

We reserve the right to cancel registration of inactive accounts and forfeit any special arrangements made in relation to those accounts.

Consistently bad ‘feedback’ may result in suspension or cancellation of your Bluecaravan account.

Unpaid accounts may result in suspension or cancellation of your Bluecaravan account.
-
We will cancel your membership if you are found to be insulting, abusive or destructive in any way to the Bluecaravan community, or to anyone in it.
-
Suspended or cancelled members are not permitted, under any circumstances, to create another membership or open another store in Bluecaravan under any other name.
Listing & Selling

Setting up a shop in Bluecaravan is free.
-
There are listing fees, wholesaling fees, and commissions (see fee schedule) that will be accrued through selling on Bluecaravan.

The Fee Schedule forms part of the Terms & Conditions of this User Agreement.

An account will be sent out to each seller at the end of each month for all costs associated with listing, selling and wholesaling on Bluecaravan.
-
The terms of a Bluecaravan account is 14 days.
-
Failure to settle your account within 14 days may result in suspension or cancellation of your account.
-
Failure to settle your account may result in the engagement of a third party debt collection service, for which you, the account holder, will be liable for costs.
-
Bluecaravan reserves the right to refuse certain listings from any seller if they do not support the aesthetic & style of Bluecaravan.
-
Listing an item on Bluecaravan becomes a binding offer for sale at that price.
-
Prior to actual sale, the details, price and other information in relation to an item can be changed.
-
Once an item has been sold, the details relating to that unique item cannot be changed under any circumstances.
-
Where the information relating to an item has been incorrect or misleading, the seller is liable to give a full refund, including postage costs, to the buyer.

The only circumstances in which an item listed for sale can be retracted after a buyer has agreed to purchase it, is when that unique item has been concurrently listed and sold elsewhere.

Where an item listed on Bluecaravan is also listed elsewhere, the seller must take immediate action to remove that same listing from Bluecaravan if it becomes ‘sold’. There will be no refund of listing fees.

Where an item listed on Bluecaravan has been sold elsewhere, the listing must be terminated immediately, the buyer must be immediately contacted, and given a full refund within 48hrs.

Where a buyer fails to fulfil their contractual obligation to buy an item, the commission and listing fee for that item will be credited back to the seller by Bluecaravan. The seller will be required to alert Bluecaravan for this to occur.

Buyers and sellers are not allowed to by-pass the fees on the Bluecaravan by developing an alternative arrangement. Where it is found or suspected that this has/is occurring, both parties may be permanently disqualified from membership on Bluecaravan.

You must not list any item on Bluecaravan (or complete any transaction initiated using Bluecaravan) that, by paying us the listing fee, wholesale fee, or commission could cause us to violate any applicable law.

As a seller, it is your responsibility to ensure that you are legally entitled to sell the items that you list for sale.

As a seller, it is your responsibility to ship/post ’sold’ (and fully paid) items to the buyer promptly. Slow delivery may justify poor feedback.

Postage, handling & wrapping costs set by the seller must be reasonable.

You will be required to give feedback. Negative feedback will need to be justified by you, and approved by Bluecaravan for publication.

Feedback must relate only to the exchange in question, must not be offensive, and must not be defamatory. It must be factual, objective and honest.

We may use public information that you provide us for promotion and marketing purposes (see Privacy Policy ). This may include written content, images, and details from your profile/items/shopfront.

The privacy policy forms part of the conditions of this user agreement.

It is not permitted to list your website address on Bluecaravan. Directing potential buyers to your own, or other on-line store is a breach of contract.
*It is a strict condition of Bluecaravan that any items listed on Bluecaravan, that are also listed in the seller’s own on-line store (or a store with which the seller is affiliated) will be of an equal or lesser price than that listed in their own (or affiliated) on-line store.
Fairtrade, Ethical Fashion, and other Certification
‘Fair Trade’, ‘Ethical Trade’ and ‘Fairtrade’ are not one and the same. ‘Fairtrade’ is a trademarked certifying body and certification system. Items carrying the Fairtrade symbol are entitled to do so through meeting the stringent criteria and auditing process set out by the Fairtrade Association, and by being licensed to do so.
‘Fair Trade’, ’Ethical Trade’ and/or ’Direct Trade’ is a movement marked by direct trade with producers, fair pay, limited or no price bargaining and safe working conditions.
‘Locally made’ or ‘Sweatshop free’ and ‘Ethical Clothing Certification’ are not one and the same. Ethical Clothing (Australia) is part of an official auditing process governed by Ethical Clothing Australia & the Home workers Association of Australia. Products carrying this label do so through successfully meeting stringent criteria set out by the association and through being licensed to do so.
‘Sweat shop free’ and ‘locally made’ is a movement marked by fair pay and working conditions for Australian textile workers, home workers and other locally employed people.

Sellers listing ‘Fair Trade’, ’Ethical’, Ethical Trade’ or ‘Direct Trade’ items are strictly forbidden from labelling them, or alluding to them as being ‘Fairtrade’ certified, or certified by another body.

Sellers listing ‘locally made’ or ‘sweatshop free’ items are strictly forbidden from labelling them, or alluding to them as ‘Ethical Clothing’ certified, or alluding to them as being certified by another body.

It is the responsibility of the seller to ensure that their listings do not infringe on these or any other official certification and labelling systems. Failure to do so may result in suspension or cancellation of your membership and account.

It is the responsibility of the seller to ensure that their items are listed appropriately, honestly and in accordance with the ‘Terms & Conditions’ of Bluecaravan.
Buying

When you, the buyer, agree to buy an item on Bluecaravan by clicking the ‘buy’ button, you are forming a binding contract to purchase that item.

By agreeing to purchase an item, you are bound to any special policies and/or conditions of the Bluecaravan store from which you purchased it; providing that those store policies are not in breach of the ‘Term & Conditions’ of Bluecaravan.

Social Networking, Communication & Interaction

Bluecaravan provides a venue and platform for social networking, communication & interacting with other members. We do not take any responsibility for the content, or accuracy of content provided by members, or for any consequences, of any kind, resulting from engaging with the content contained in these, or any other features of Bluecaravan.

Bluecaravan is not responsible for any consequences, of any kind, resulting from interaction with any person met through the Bluecaravan site. This includes consequent interaction in other on-line forums, networks, emails or in person.

All communication between members of Bluecaravan must be inoffensive, respectful, lawful and not defamatory in any way.

The content of any communication on Bluecaravan must not be illegal, or promote illegal activity in any way.
PayPal Acceptable Use Policy
You are independently responsible for complying with all applicable laws in all of your actions related to your use of PayPal's services, regardless of the purpose of the use. In addition, you must adhere to the terms of this Acceptable Use Policy.
Prohibited Activities
You may not use the PayPal service for activities that:
violate any law, statute, ordinance or regulation
relate to sales of (a) narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, (b) drug paraphernalia, (c) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (d) items that promote hate, violence, racial intolerance, or the financial exploitation of a crime, (e) items that are considered obscene, (f) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (g) certain sexually oriented materials or services, or (h) ammunition, firearms, or certain firearm parts or accessories, or (i) ,certain weapons or knives regulated under applicable law
relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, matrix programs, other “get rich quick” schemes or certain multi-level marketing programs, (c) are associated with purchases of real property, annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) are for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f), are associated with the following Money Service Business activities: the sale of traveler’s checks or money orders, currency exchanges or check cashing,or (g) provide certain credit repair or debt settlement services
involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent
violate applicable laws or industry regulations regarding the sale of (a) tobacco products, or (b) prescription drugs and devices
involve gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not it is legally defined as a lottery) and sweepstakes unless the operator has obtained prior approval from PayPal and the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.
Bluecaravan is a community, and we expect that by engaging in the use of Bluecaravan you are doing so to promote the community, to help others in your community and to act with integrity while you are here.
